Every business has a duty to manage asbestos in order to ensure legal compliance as well as meeting the requirements of most insurers.
Who has responsibility for these the obligations?
• The duty rests with those who are the “duty holders†who may be:
• The building owners
• The contract or tenancy agreement holders
• Those in control of the building but are not the tenancy holder or the owner
• Those responsible for maintenance and repairs for the whole building.
Those who are not the duty holder but have information about the buildings must cooperate with the “duty holderâ€. The buildings are covered by the Regulations and include all non domestic buildings, whatever the type of business, and any common areas of residential rented buildings. However with new corporate legislation Directors have personal liabilities and need to ensure that employees are not exposed to airborne asbestos.
